The British political theorist and architect Arthur J. Penty (1875-1937) is today remembered as the co-originator of ‘post-industrialism’ and as the first guild socialist. His writings evince a lifelong aversion to the evils of commercial society, as well as an intense appreciation for Medieval life. Yet Penty's conservative tendencies belie his attentiveness to what Harold Perkin would call ‘professional society.’ Though he abhorred capitalism, Penty believed in assigning status to workers on the basis of social function and technical expertise. Most (...) surprisingly, given his reputation, he held that the guarantee of such status represented the first step towards a more democratic society. This essay accordingly recasts Penty as a political theorist of the professions. It does so through the analysis of not only his core interventions in political theory, but also his lesser-known trade writings. The first section focuses on Penty's early life and context. The second explains his historical understanding of architectural decline through his contrasting narratives of Classical and Gothic aesthetics. The third section outlines his theory of how to restore democratic architecture in modernity. The fourth section comments on Penty's larger significance in the history of ideas at a time of increasing populist references to ‘traditional’ aesthetics. (shrink)

Early expressivists, such as A.J. Ayer, argued that normative utterances are not truth-apt, and many found this striking claim implausible. After all, ordinary speakers are perfectly happy to ascribe truth and falsity to normative assertions. It is hard to believe that competent speakers could be so wrong about the meanings of their own language, particularly as these meanings are fixed by the conventions implicit in their own linguistic behavior. Later expressivists therefore tried to arrange a marriage between expressivism and the (...) truth-aptness of normative discourse. Like many arranged marriages, this has not been an entirely happy one. In particular, the marriage has seemed to depend on so-called deflationist theories of truth, and these may well turn out to provide at best a shaky foundation for any marriage. Before advising the parties to file for divorce, though, we should first see whether expressivism itself has not been misunderstood. I argue that the marriage of expressivism to the truth-aptness of normative discourse can indeed be saved, though only in the context of a version of expressivism I call “Ecumenical Expressivism.”. I offer new arguments for an unorthodox reading of J. L. Mackie’s Ethics: Inventing Right and Wrong, one on which Mackie does not think all substantive moral claims are false, but allows that a proper subset of them are true. Further, those that are true should be understood in terms of a “hybrid theory”. The proposed reading is one on which Mackie is a conceptual pruner, arguing that we should prune away error-ridden moral claims but hold onto those already free (...) of error. This reading is very different from the standard ones found in the literature. I build on recent work by Moberger and argue that this reading is better corroborated by close attention to the way in which Mackie argues at length that terms like “good” and “ought” are systematically context-sensitive, as well as by considerable additional textual evidence. This reading, however, faces an important challenge—to explain in what sense, if any, morality retains its “normativity” on the proposed reading. I argue that this challenge can be met, at least given some of Mackie’s further assumptions about the nature of rationality. (shrink)

According to one formulation of Scanlon ’s contractualist principle, certain acts are wrong if they are permitted by principles that are reasonably rejectable because they permit such acts. According to the redundancy objection, if a principle is reasonably rejectable because it permits actions which have feature F, such actions are wrong simply in virtue of having F and not because their having F makes principles permitting them reasonably rejectable. Consequently Scanlon ’s contractualist principle adds nothing to the reasons we have (...) not to act wrongly and is redundant. In ‘ Scanlon ’s contractualism and the redundancy objection’ I argued that the redundancy objection is based upon the false assumption that Scanlon regards his contractualist principle as a ground of moral wrongness – that is, as telling us what makes certain acts wrong. I pointed out that he does not regard his principle in this way, but regards it as telling us what moral wrongness is. So the redundancy objection is based on a mistake. Nonetheless, Scanlon is still vulnerable to a version of this objection because he regards the moral wrongness of j ing as a reason not to j. Given that he identifies the fact that j ing is wrong with the fact that j ing is permitted by a reasonably rejectable principle, he is committed to the view that his contractualist principle gives us a reason not to j. His critics can thus still insist that the only reason we have not to do such acts is provided. (shrink)

This paper describes issues associated with integrating the study of Ethical, Legal and Social Issues (ELSI) into ongoing scientific and technical research and describes an approach adopted by the authors for their own work with the center for nanophase materials sciences (CNMS) at the Oak Ridge national laboratory (ORNL). Four key questions are considered: (a) What is ELSI and how should it identify and address topics of interest for the CNMS? (b) What advantages accrue to incorporating ELSI into the (...) CNMS? (c) How should the integration of ELSI into the CNMS take place? (d) How should one judge the effectiveness of the activity? We conclude that ELSI research is not a monolithic body of knowledge, but should be adapted to the question at hand. Our approach focuses on junctures in the R&D continuum at which key decisions occur, avoids topics of a purely ethical nature or advocacy, and seeks to gather data in ways that permit testing the validity of generalization. Integrating ELSI into the CNMS allows dealing with topics firmly grounded in science, offers concrete examples of potential downstream applications and provides access to the scientists using the CNMS and their insights and observations. As well, integration provides the opportunity for R&D managers to benefit from ELSI insights and the potential to modify R&D agendas. Successful integration is dependent on the particular ELSI question set that drives the project. In this case questions sought to identify key choices, information of value to scientists, institutional attributes, key attributes of the CNMS culture, and alternatives for communicating results. The opportunity to consult with scientists on ELSI implications is offered, but not promoted. Finally, ELSI effectiveness is judged by observing the use to which research products are put within the CNMS, ORNL, and the community of external scholars. (shrink)

An ongoing philosophical discussion concerns how various types of mental states fall within broad representational genera—for example, whether perceptual states are “iconic” or “sentential,” “analog” or “digital,” and so on. Here, I examine the grounds for making much more specific claims about how mental states are structured from constituent parts. For example, the state I am in when I perceive the shape of a mountain ridge may have as constituent parts my representations of the shapes of each peak and (...) saddle of the ridge. More specific structural claims of this sort are a guide to how mental states fall within broader representational kinds. Moreover, these claims have significant implications of their own about semantic, functional, and epistemic features of our mental lives. But what are the conditions on a mental state's having one type of constituent structure rather than another? Drawing on explanatory strategies in vision science, I argue that, other things being equal, the constituent structure of a mental state determines what I call its distributional properties—namely, how mental states of that type can, cannot, or must co‐occur with other mental states in a given system. Distributional properties depend critically on and are informative about the underlying structures of mental states, they abstract in important ways from aspects of how mental states are processed, and they can yield significant insights into the variegation of psychological capacities. Recent accounts of the life of Protagoras differ widely from one another in their treatment of the ancient sources, and in the conclusions which they draw from them. A re-examination of the evidence, undertaken in 1949–50 as part of a study of the Prometheus trilogy, has convinced me that a new discussion is urgently needed if we are to place the earlier stages of the sophistic movement in the right context historically; and the purpose of this paper is to lay (...) at least a part of the foundation for such a discussion. Since the evidence for the life of Protagoras includes some allusions to his relations with Democritus, and there are some obvious affinities between the careers of Protagoras and Anaxagoras, I have added a short account of the relevant points in the biography of Democritus and a more detailed study of the evidence for the life of Anaxagoras. “Spinoza's Extended Substance: Cartesian and Leibnizian Reflections” This essay examines Woolhouse's interpretation of Spinoza's extended substance. According to that interpretation, the extended substance is a quasi‐Platonic form, and Spinoza's substance is not actually extended. This essay argues that the burden of defending such an interpretation is very great indeed, and requires that we read Spinoza's understanding of Descartes and Leibniz's understanding of Spinoza in unusual and awkward ways.

Adherents of traditional western Theism have espoused CONJUNCTION: God is essentially perfectly good and God is thankworthy for the good acts he performs. But suppose that (i) God’s essential perfect goodness prevents his good acts from being free, and that (ii) God is not thankworthy for an act that wasn’t freely performed. Together these entail the denial of CONJUNCTION. The most natural strategy for defenders of CONJUNCTION is to deny (i). We develop an argument for (i), and then identify two (...) ways for the defender of CONJUNCTION to respond. Next we turn to a considerably different, rather less obvious route toward defending CONJUNCTION that is compatible with (i)—one which instead denies (ii). Here too we identify two ways for the defender of CONJUNCTION to proceed, yielding a total of four ways for the theist to respond. Because the last of these represents an important and underappreciated alternative for the theist, we devote the second half of the paper to developing and defending it. We argue that divine responsibility is sufficient for divine thankworthiness and consistent with the absence of divine freedom. We do this while insisting on the view that both freedom and responsibility are incompatible with causal determinism. (shrink)

Due Process is one of the most interesting and conceptually challenging areas of the common law, and in recent years there has been a major revival of interest in the sheer range and applicability of the term. In this major new book, the author of the widely admired Discretionary Powers offers a study of the underlying principles of due process and fair procedures, and sets the discussion within a broad comparative and theoretical framework. Extant semantic theories for languages containing vague expressions violate intuition by delivering the same verdict on two principles of classical propositional logic: the law of noncontradiction and the law of excluded middle. Supervaluational treatments render both valid; many-Valued treatments, Neither. The core of this paper presents a natural deduction system, Sound and complete with respect to a 'mixed' semantics which validates the law of noncontradiction but not the law of excluded middle.

Whenever some form of beneficent killing--for example, voluntary euthanasia--is advocated, the proposal is greeted with a flood of slippery-slope arguments warning of the dangers of a Nazi-style slide into genocide. This paper is an attempt systematically to evaluate arguments of this kind. Although there are slippery-slope arguments that are sound and convincing, typical formulations of the Nazi-invoking argument are found to be seriously deficient both in logical rigour and in the social history and psychology required as a scholarly underpinning. As (...) an antidote, an attempt is made both to identify some of the likely causes of genocide and to isolate some of the more modest but legitimate fears that lie behind slippery-slope arguments of this kind. At least since the seminal work of the (US) National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research in the 1970s, a fundamental distinction between research and practice has underwritten both conceptual work in research ethics and regulations governing research involving human subjects. Notwithstanding its undoubted historical importance, I believe the distinction is problematic because it misrepresents clinical inquiry. In this essay, I aim to clarify the character of clinical inquiry by identifying crucial contextual constraints on (...) justification constitutive of clinical science. This analysis shows that, from an epistemological point of view, clinical research and clinical practice are not sharply distinct but intimately intertwined. This result is important in its own right—an enriched understanding of the epistemology of clinical research is valuable in and of itself. But this result is also important because it has profound implications for the ethics of human subjects research. (shrink)

I aim to show how and why some definitions can be benignly circular. According to Lloyd Humberstone, a definition that is analytically circular need not be inferentially circular and so might serve to illuminate the application-conditions for a concept. I begin by tidying up some problems with Humberstone's account. I then show that circular definitions of a kind commonly thought to be benign have inferentially circular truth-conditions and so are malign by Humberstone's test. But his test is too demanding. The (...) inferences we actually use to establish the applicability of, e.g., colour concepts are designed to establish warranted assertability and not truth. Understood thus, dispositional analyses are not inferentially circular. (shrink)

Although this note is prompted by the recent exchange between Gellner [2], [3] and Needham [4], I shall ignore the issues raised by Gellner's specification for an ideal language. I am concerned here only with Needham's statement that ‘biology is one matter and descent is quite another, of a different order’ which, it will be remembered, Gellner treats as Needham's first error. I write under a sense of obligation, for I discussed this matter with Gellner in 1955 while he was (...) preparing his first article and my arguments then were phrased similarly to those advanced by Needham. It appears that I did not make myself clear to Gellner and I shall try again. I do not wish to attack or defend either protagonist; each is quite able to look after himself. Therefore I propose neither to examine where they have misunderstood each other, nor to discuss the difference between kinship and descent, but simply to state the connexion, as I see it, between physical and social kinship. In The Face of Emotions, which was Carroll Izard’s first major attempt at elaborating his differential emotions theory, he stated that the book “presents a theoretical framework for the study of emotions and their role in personality and interpersonal processes.” Yet, over the years, his contribution to personality theory has generally been overshadowed by the attention focused on his views on facial expressions and the structure of emotions. This article will begin with a brief overview of the DET perspective on (...) personality development. Then, it will examine how the DET framework can be used to organize recent findings from three lines of research on adult personality. It will conclude with suggestions for future research as well as some personal recollections. (shrink)
